These Terms of Service ("Terms") cover your use of BoostsLocal (the "Service"). By creating an account or using the Service in any way, you agree to these Terms and our Privacy Policy.
If you sign up on behalf of a business, you confirm you have authority to commit that business to these Terms. If you don't agree, or don't have that authority, please don't use the Service.
BoostsLocal provides websites to local service businesses on a subscription model. We build your site at signup and keep it online for as long as you remain subscribed.
Your subscription includes hosting, security updates, and basic local search optimization. It doesn't include custom design work or marketing campaigns. Whether the website actually brings you customers depends on many things we can't control, so we don't promise specific results.
Sign up requires accurate information about you and your business; please keep it current. You're responsible for keeping your account credentials private, and for anything that happens under your account.
You must be at least 18 years old and authorized to enter into binding contracts on behalf of your business to use the Service.
Tell us right away if you notice anyone accessing your account without permission. We're not responsible for loss or damage that results from your failure to protect your account credentials.
You pay $249 once when you sign up, then $49 a month. Cancel anytime.
PayPal processes all our payments. BoostsLocal is the seller of record for all subscriptions; PayPal is the payment processor only. When you pay us, PayPal's terms and privacy policy also apply.
The monthly subscription fee renews automatically every 30 days from the date of your initial subscription. You can cancel at any time by emailing support@boostslocal.com from the address associated with your account (see Section 12.1 for full cancellation details); cancellation takes effect at the end of the current billing period.
We may change our pricing at any time. We will notify you of any price changes at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new price.
If a payment fails, we will retry the charge over a period of up to 7 days. If payment cannot be successfully processed, your account may be suspended and your generated website may be temporarily taken offline until payment is resolved.
The one-time setup fee is refundable within 30 days of purchase. Email support@boostslocal.com from the same email you used to sign up.
Monthly subscription fees are non-refundable once a billing cycle has begun. Cancellation takes effect at the end of the current billing cycle; we do not pro-rate refunds for partial months.
If we register a custom domain on your behalf, the registration fee covers what we pay to the third-party registrar. Once we've completed the registration, that fee is non-refundable — the registrar doesn't refund it to us. The domain itself is registered in your name from day one and stays yours regardless of your BoostsLocal subscription. You can transfer it to another registrar at any time, including after cancellation.
You keep all ownership rights to the business information you give us to display on your website — photos, logos, descriptions, anything else you provide. We refer to this as "Your Content" in these Terms.
When you give us Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, copy, transmit, and display it for the purpose of operating, providing, and improving the Service. This license ends when you delete the content or close your account, except where retention is required by law or needed for backups.
By submitting Your Content, you represent and warrant that it is genuinely yours (owned by you or used with permission), accurate and not misleading, compliant with applicable laws, and free from infringement of anyone else's intellectual property, privacy, or publicity rights.
You agree not to use the Service in any of the following ways: (a) to engage in or promote illegal activities; (b) to publish content that is defamatory, obscene, harassing, or fraudulent, or that violates the rights of others; (c) to distribute malware or other harmful code; (d) to disrupt or compromise the security of the Service; (e) to reverse-engineer or extract the source code of our platform; (f) to impersonate any person or entity; or (g) to resell access to the Service without our written permission.
If you violate these rules, we may suspend or terminate your account immediately, with or without notice.
The Service — including the platform code, generation logic, design templates, branding, and all related intellectual property — is owned by BoostsLocal and protected by copyright, trademark, and other intellectual property laws.
The website that the Service generates for you (the "Generated Site") is provided to you under a non-exclusive license for use during your active subscription. The HTML, CSS, and content of the Generated Site that pertains to your business are yours to use; the underlying platform infrastructure, generation logic, and design system remain ours.
If you cancel your subscription, you may export the static HTML/CSS files of your Generated Site within 30 days of cancellation by emailing support@boostslocal.com.
If you purchase a custom domain through the Service, the domain is registered in your name (or your business's name) at a third-party registrar. You are the legal owner of the domain and may transfer it away at any time.
Domain registration fees are non-refundable once we've completed registration with the registrar, as noted in Section 5.3. If you cancel your subscription, you keep the domain — we will help you transfer it to another registrar of your choice at no cost.
The Service runs on third-party infrastructure — primarily Amazon Web Services, Cloudflare, and Google — and uses PayPal for payment processing. Your use of these third parties is governed by their own terms and privacy policies. If a third-party service has downtime, performance issues, or other problems affecting your site, we are not responsible for those.
We work to keep the Service running, but we cannot promise it will be uninterrupted, free from errors, or fully secure at all times. Downtime can come from scheduled maintenance, problems at our infrastructure providers, force majeure events (severe weather, war, government action), or other things outside our reasonable control.
For scheduled maintenance, we use commercially reasonable efforts to give you advance notice.
You can cancel your subscription at any time from your account settings, or by emailing support. The current billing cycle, which you've already paid for, continues to its end; the next billing cycle is not charged.
We may suspend or terminate your account, with or without prior notice, if (a) you breach these Terms (including the Acceptable Use Policy), (b) you fail to pay fees when due, (c) you engage in fraudulent or illegal activity, or (d) your conduct poses a risk to other users or the integrity of the Service.
Upon termination, your Generated Site will be taken offline within 30 days. You may request an export of your data within that window. Sections of these Terms that by their nature should survive termination (such as ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOSTSLOCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
You agree to indemnify, defend, and hold harmless BoostsLocal, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of:
If a dispute arises under these Terms, we try to resolve it through good-faith discussion first. If that fails, the dispute is settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with the seat of arbitration in California, USA. The arbitration may be conducted remotely — by phone, video, or written submission — to keep costs reasonable for both sides. Either party may instead bring claims under $10,000 in small claims court.
You waive your right to a jury trial and to participate in any class action with respect to any dispute under these Terms.
These Terms are governed by the laws of the State of California, USA, applied without regard to conflict-of-laws principles. If you are a consumer, mandatory consumer protection laws of your jurisdiction may still apply.
We may update these Terms. The "Last updated" date at the top of this page reflects the most recent version. For changes that materially affect your rights, we will email you or post a prominent notice on the Site at least 30 days before the new version takes effect.
If you continue using the Service after that date, you accept the updated Terms.
